Controverting a Claim

The injured employee is entitled to Continuation of Pay (COP) up to 45 calendar days unless the employing agency (i.e. supervisor) controverts the claim for the following reasons:

  • If a occupational disease claim was filed for this injury
  • If the employee is not a citizen
  • If the employee did not file a Traumatic Injury form within 30 days of the injury
  • If the injured employee reports the injury after employment was terminated
  • If the injured employee was injured off agency premises and the employee was not on official agency business
  • If the injury occurred due to the employee’s willful misconduct
